1. About These Terms

These Terms, together with our Privacy Policy, Shipping Policy, and Returns, Refunds & Warranty Policy, form the entire agreement between you and us in relation to your use of the Site and any orders you place. Where there is any conflict, these Terms take precedence in respect of the contract of sale, and the specific policy documents govern their respective subject matter.

We may amend these Terms from time to time. The version that applies to your order is the version published on the Site at the time you place your order. We recommend you review these Terms each time you make a purchase.

2. Eligibility

To place an order through the Site you must be at least 18 years of age (or the age of legal majority in your country of residence) and capable of forming a legally binding contract. By placing an order you confirm that you meet these requirements.

3. Products

We sell BMX bicycles, parts, components, apparel, and related accessories. We take all reasonable care to ensure that product descriptions, specifications, images, and prices displayed on the Site are accurate at the time of publication. However:

  • Product images are for illustration only and actual products may vary slightly in appearance, colour, or finish.
  • We reserve the right to correct any errors or omissions in product information, pricing, or availability without prior notice.
  • All products are subject to availability. If a product becomes unavailable after you place an order, we will contact you to offer an alternative or a full refund.

BMX and cycling products are intended for use by riders who understand and accept the inherent risks of the sport. Please refer to our Disclaimer for further information regarding product use, suitability, and safety.

4. Pricing

All prices are displayed in pounds sterling (GBP) and, where applicable, include VAT at the prevailing rate. Delivery charges are shown separately at checkout before you confirm your order. Please refer to our Shipping Policy for current delivery rates and thresholds.

We reserve the right to change prices at any time, but changes will not affect orders for which we have already sent a dispatch confirmation. In the event that a product is listed at an incorrect price due to a typographical or system error, we are under no obligation to fulfil the order at the incorrect price and will notify you before dispatch so that you may confirm or cancel.

5. Payment

We accept the following payment methods:

  • PayPal
  • Credit and debit cards — Visa, Mastercard, American Express, and any other card types displayed at checkout [CONFIRM ACCEPTED CARD TYPES]
  • Any additional methods displayed at checkout (for example, Apple Pay, Google Pay, or Shop Pay, where available)

Payment is taken in full at the time you place your order. All payments are processed securely through our payment providers. We do not store full card details on our own systems. By submitting payment information, you confirm that you are authorised to use the payment method provided.

6. Orders and Contract Formation

When you place an order, you will receive an acknowledgement email confirming that we have received your order. This acknowledgement does not constitute acceptance of your order. A binding contract between you and us is formed only when we send you a dispatch confirmation email confirming that the goods have been sent.

We reserve the right to refuse or cancel any order before dispatch, including (but not limited to) where the product is unavailable, where there has been a pricing or description error, or where we suspect fraudulent activity. If we cancel an order for which you have already paid, we will issue a full refund.

7. Delivery

We deliver within the United Kingdom using the carriers and timescales set out in our Shipping Policy. Risk in the goods passes to you upon delivery. Estimated delivery times are provided in good faith but are not guaranteed. For full details of delivery options, charges, processing times, and carriers, please see our Shipping Policy.

8. Your Right to Cancel (14-Day Cooling-Off Period)

If you are a consumer based in the United Kingdom or the European Union, you have the right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (UK) and equivalent EU consumer protection law.

  • You may cancel your order at any time before dispatch, and within 14 days of receiving the goods, without giving any reason.
  • To exercise this right, please notify us in writing at sales@controlbmx.com within the 14-day period.
  • Following cancellation, you must return the goods to us without undue delay and in any event within 14 days of notifying us.
  • We will refund the price of the goods, and the standard delivery cost, within 14 days of receiving the returned goods (or evidence that you have returned them).

This cancellation right does not apply to certain goods, including items that are made to order, personalised, or that have been used beyond what is necessary to establish their nature and characteristics. Full details of returns, exclusions, and the return process are set out in our Returns, Refunds & Warranty Policy.

9. Returns, Refunds and Warranty

Your statutory rights as a consumer (including under the Consumer Rights Act 2015) are not affected by these Terms. If goods are faulty, not as described, or not fit for purpose, you are entitled to a repair, replacement, or refund as required by law.

For full details of how to return an item, refund timeframes, who pays return shipping, and warranty terms, please refer to our Returns, Refunds & Warranty Policy.

We reserve the right to suspend or terminate your access if we reasonably believe you have breached these Terms.

12. Limitation of Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

Subject to the above:

  • We are not liable for any loss or damage arising from the misuse of products, failure to follow manufacturer instructions, or use of products in a manner for which they were not intended. • We will not be liable for any indirect, incidental, or consequential loss, or for loss of profit, revenue, or data.
  • Our total liability to you in respect of any order will not exceed the total price paid by you for that order.

Nothing in this clause affects your statutory rights as a consumer.

13. Events Outside Our Control (Force Majeure)

We will not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to strikes, carrier delays, supply chain disruption, extreme weather, or acts of government.

14. Privacy and Data Protection

We process your personal data in accordance with our Privacy Policy and applicable data protection law, including the UK GDPR and the Data Protection Act 2018. Please refer to our Privacy Policy for full details of how we collect, use, and protect your personal data.
